Trademark Registration in Nigeria: Protect Your Brand Before It's Too Late

The name on your door, the logo on your product, the tagline in your advertising — these are assets, and like every asset they can be stolen. A registered trademark, obtained under the Trademarks Act, gives you the exclusive right to use your mark in Nigeria and the legal tools to stop others from trading on your goodwill.

What Can Be Registered

Words, logos, devices, slogans, shapes and even sounds can be registered as trademarks, provided they are distinctive and not identical or confusingly similar to an existing mark. Generic or descriptive terms are difficult to protect — which is why brand choices made early matter so much.

The Nice Classification

Trademarks are registered in classes under the Nice Classification system — 45 classes covering goods and services. Registering in the wrong class leaves you exposed precisely where your competitors will attack, so identifying your current and future classes is a strategic decision, not an administrative one.

Search, Filing and Registration

  • Conduct a search at the Trademarks Registry to identify conflicting marks
  • File your application with the appropriate class specifications
  • Registry examination of the application
  • Publication of the mark in the Trademarks Journal
  • Two-month window for third-party opposition
  • Registration and issuance of your certificate

Duration and Renewal

A Nigerian trademark is initially registered for seven years and renewable indefinitely for periods of fourteen years. Marks that are not renewed — or are not genuinely used — can be lost. Diarise your renewals and keep evidence of use.
